A BILL to amend and reenact section one hundred twelve, article
seven, chapter forty-six-a of the code of West Virginia, one
thousand nine hundred thirty-one, as amended by granting the
attorney general the right to request a jury trial in
consumer protection cases.
Be it enacted by the Legislature of West Virginia:
That section one hundred twelve, article seven, chapter
forty-six-a of the code of West Virginia, one thousand nine
hundred thirty-one, as amended, be amended and reenacted
to read as follows:
ARTICLE 7. JURY TRIAL.
§46A-7-112. Jury trial.
In an action brought by the attorney general under this
chapter, he has no a right to trial by jury.
NOTE: The purpose of this bill is to grant the Attorney
General the right to request a jury trial in consumer protection
cases.
